Senators Introduce Companion Bill to Address CNA Lockout Issue for Nursing Home Members

Tim Scott (R-SC) introduced bipartisan legislation (S. 2993) in the Senate that will end the mandatory 2-year CNA lockout for nursing homes if they have been fined over a certain threshold amount. Dear Official,

As a constituent and a provider of aging services in our community, I am asking you to support nursing home quality by cosponsoring H.R. 4468/S 2993.
The fundamental mission of my organization is to provide the highest quality of services to our  residents.
Under federal law, nursing homes are surveyed, or inspected, yearly with fines assessed for any deficiencies in compliance with federal regulations. If these civil monetary penalties exceed a certain level ($10,697 as of 2018), a nursing home automatically loses its authority to train certified nursing assistants (CNAs) who provide extensive direct care to residents.
This mandatory lockout lasts for 2 years, an arbitrary period that serves no purpose and has no basis in good nursing home care. The lockout is imposed even if the care deficiencies cited on the survey do not compromise resident safety and welfare and are unrelated to the nursing home’s CNA training program.
H.R. 4468 and S. 2993 allow nursing homes to regain their nursing assistant training authority when all deficiencies have been corrected and authorize CMS to monitor homes as necessary. S. 2993 has additional limits on which homes can regain their training program and allows nursing homes to have access to the National Practitioner Data Bank to improve background checks. Both bills are important to facilitate quality improvement in our national’s nursing homes.
