Last week, U.S. Rep. Raul Ruiz (D-CA), an emergency physician and member of the House Energy & Commerce Committee, introduced bill HR 3502 entitled the Protecting People From Surprise Medical Bills Act. This bill protects patients from surprise bills by banning balance billing for unanticipated out-of-network (OON) care and requires payment at a "commercially reasonable rate." The bill also establishes independent dispute resolution - including private settlement and "baseball" arbitration - when insurers and providers disagree over payment.
Early next week, the House Energy & Commerce Committee will likely consider legislation that bans balance billing for unanticipated care and sets reimbursement for OON care at the plan’s median in-network rate. This threatens to cause reimbursement for emergency care to spiral downward over time and networks to become even narrower because insurers have no incentive to contract.
