Urgent -- Stop Bad out of network Bill in the Massachusetts House

The Massachusetts House of Representatives has advanced end of session legislation on Out-of-Network (OON) billing.  H.4871 would reimburse OON emergency care at in-network rates when there is a contract with that commercial insurance carrier and 135% of Medicare when there is no contract with that carrier, effective from the time of passage until July 31, 2021. These provisions will erode our ability to negotiate fair rates with insurers, jeopardize our ability to continue to provide critical services and threaten to close smaller community emergency departments, especially when COVID-19 resurgences and unpredictability is likely. 

MACEP does not support this OON language but does support taking patients out-of-the middle when it comes to OON billing disputes.  This bill strongly favors commercial insurance carrier profits at a time when emergency physicians have put themselves and their families at daily risk caring for patients during the COVID-19 pandemic and are already financially strained with an average 50% decrease in patient volumes across the state. 

H.4871 could be on the House floor for debate as early as Saturday July 25th. We must take action to prevent this bill from passing the House as currently drafted
