HR 1136--The FDA Deeming Authority Clarification Act of 2017--has been introduced by Representatives Tom Cole (R-OK) and Sanford Bishop (D-GA). This bill would effectively modernize the predicate date established by the Tobacco Control Act (TCA) by allowing vapor products that were sold before August 8th, 2016 to remain on the market without being subject to the FDA’s prohibitive premarket approval process.
We must redouble our efforts to gather support for HR 1136 and urge congress to include the language in the FY2018 US budget.
If Congress does not act to change the predicate date established by the TCA,
the wide variety of vapor products that adult smokers have come to rely on to live smoke-free will be swept off the market.
